These Terms of Service (“Terms”) govern your access to and use of the AIDMplatform, website, and related services (collectively, the “Service”) operated by AIDM. By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and authorized to bind the business you represent. You represent that the information you provide is accurate and that you will comply with applicable laws, including messaging, marketing, and data protection regulations.
2. The Service
AIDMprovides tools to connect WhatsApp Business accounts through Meta’s platform, manage contacts, create templates, send broadcasts, and operate customer conversations. We may modify, suspend, or discontinue features at any time.
3. Account registration and security
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly at support@aidm.me if you suspect unauthorized access.
4. WhatsApp and Meta compliance
Your use of WhatsApp messaging features is subject to Meta’s terms, policies, and WhatsApp Business messaging rules, including opt-in requirements, template approval, and acceptable use restrictions. You are solely responsible for obtaining valid consent from recipients before messaging them and for the content you send.
5. Customer data and privacy
When you upload or process contact or conversation data in AIDM, you act as the controller of that data and are responsible for providing appropriate notices and obtaining lawful permissions. Our processing of such data on your behalf is described in our Privacy Policy.
6. Acceptable use
You agree not to:
- Send unlawful, deceptive, abusive, or spam messages
- Violate WhatsApp, Meta, or third-party platform policies
- Upload data without proper rights or consent
- Attempt to bypass rate limits, security controls, or access restrictions
- Reverse engineer, scrape, or interfere with the Service
- Use the Service to distribute malware or harmful content
We may investigate violations and suspend or terminate accounts that create risk to users, partners, or the Service.
7. Subscriptions and billing
Paid plans renew according to the billing cycle selected at purchase unless canceled. Fees are non-refundable except where required by law or explicitly stated otherwise. Failure to pay may result in suspension or downgrade of your account.
8. Intellectual property
AIDM and its licensors own the Service, software, branding, and documentation. You retain ownership of content you submit. You grant us a limited license to host, process, and transmit your content solely to operate the Service.
9. Third-party services
The Service integrates with third parties such as Meta, WhatsApp, and payment processors. Your use of those services is governed by their separate terms. We are not responsible for third-party outages, policy changes, or account actions taken by those providers.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE MESSAGE DELIVERY, TEMPLATE APPROVAL, OR UNINTERRUPTED OPERATION.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIDM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO AIDM IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
12. Indemnification
You will defend and indemnify AIDM against claims arising from your content, messaging activity, violation of these Terms, or violation of applicable law or third-party rights.
13. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach, legal requirement, or risk to the platform. Upon termination, your right to use the Service ends. Sections that by nature should survive will survive termination.
You may request deletion of your data as described in our Data Deletion Instructions.
14. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in India will have exclusive jurisdiction over disputes arising from these Terms, except where mandatory consumer protection laws provide otherwise.
15. Changes
We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance of the revised Terms.
